Privacy Policy

Because we value you as our customer, we want to address any privacy concerns you may have. This Privacy Policy explains what information we collect when you use our website, forms, quizzes, home tools, and services, or when you submit information as part of a real estate transaction with Kim Douthit, Realtor, affiliated with Keller Williams Advisors (together with Keller Williams Realty, LLC and its affiliates, “Keller Williams”). In this policy, “we,” “us,” and “our” mean Kim Douthit, Realtor. We want your decision to do business with us to be an informed one, so this policy also explains how we use that information and when we may share it. We may update this policy from time to time. Changes take effect when we post the revised policy with a new Effective Date, so please review it periodically.

1. Information We Collect

We collect two kinds of information: (a) information you provide that identifies you, and (b) information that does not identify you, which we collect automatically or which you provide.

a. Personal Information. This may include your name, physical address, email address, telephone and mobile numbers, details about your home and your real estate, lending, title, and insurance needs, and other details you share with us. We receive it when you complete a form, quiz, home value request, or listing alert, contact us by phone, text, or email, or share documents as part of a transaction (“Personal Information”).

b. Non-Personal Information. This is information that does not personally identify you (“Non-PII”), including information that has been de-identified. It includes information you provide and information we collect automatically, such as your IP address, browser type, operating system, the website you came from, your internet service provider, the search terms you use on our site, the pages you visit, how long and how often you visit, and your general location.

c. Cookies and Other Tracking Technologies. When you visit our website, we and our service providers may use cookies, web beacons, pixels, server logs, and similar tools to customize your experience, measure site traffic, and improve our marketing, including advertising on other platforms. These tools may record the date, time, and location of your visit, the pages you view, your search queries, and basic information about your device. By continuing to browse our site, you agree to our use of cookies. Most browsers accept cookies automatically but let you block or delete them in their privacy settings. If you delete cookies, some preferences may need to be set again. Our site may not respond to “Do Not Track” signals.

Links to Other Sites. Our site may link to websites we do not control. This policy does not cover those sites, and we are not responsible for how they handle information.

2. How We Use and Share Information

a. Personal Information. We use the Personal Information you share with us to:

•         carry out your requests and customize your online and real estate experience, including sending quiz results and information you ask for

•         communicate with you about your real estate transaction

•         tell you about our services and other offerings, and send promotional or marketing information

•         validate your identity

•         operate and improve our website and marketing

We may share Personal Information with service providers that act on our behalf, such as providers of our website, customer relationship management, email, text messaging, analytics, and marketing tools; with lenders, title and insurance companies, and other professionals involved in your transaction; and with Keller Williams. These parties may use the information only to carry out our requests. We do not sell your Personal Information. Except as described in this policy or when you submit the information, we will not use it outside the scope of this policy without your approval. We may disclose information to cooperate with law enforcement or legal process, to protect our legal rights, or to protect the public good. Text messaging information is handled as described in Section 3.

b. Non-PII. We use Non-PII to analyze site traffic, understand customer needs and trends, carry out targeted promotions, and improve our services. We may combine it with information from other sources and share it with affiliates and third parties for these purposes. Aggregate information does not identify you.

You may opt out of marketing or ask us not to share your information as described in Section 8. To review or change information we have collected about you, contact us as described there. We may need to verify your identity first.

3. Text Messages and Email

If you give us your mobile number and agree to receive texts, you consent to receive text messages from us about your inquiry, your home, listings, and our real estate services. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. Consent to receive texts is not a condition of buying or selling a home or of any purchase. We do not share mobile phone numbers or text messaging consent with third parties or affiliates for their marketing or promotional purposes. We may share them with service providers that help us send messages. You can unsubscribe from marketing emails using the link in any email.

4. Children’s Privacy

Our website and services are intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we will delete it.

5. Security and Retention

We use commercially reasonable security practices to protect your information, but no method of transmission or storage is completely secure, and we cannot guarantee the security of information you provide. Whenever you are online, you run the risk that information you provide will fall into the wrong hands. We keep Personal Information as long as needed for the purposes described here and to meet legal and recordkeeping requirements. We accept no responsibility or liability for the activities of third parties.

6. Processing Location

We process your personal information in the United States. See Section 10 for international users.

7. Anti-Fraud Disclosure

YOU SHOULD NEVER TRANSMIT NONPUBLIC PERSONAL INFORMATION, SUCH AS CREDIT OR DEBIT CARD NUMBERS OR BANK ACCOUNT OR ROUTING NUMBERS, BY EMAIL OR OTHER UNSECURED ELECTRONIC COMMUNICATION. EMAILS ATTEMPTING TO INDUCE FRAUDULENT WIRE TRANSFERS ARE COMMON AND MAY APPEAR TO COME FROM A TRUSTED SOURCE.

If you receive any electronic communication directing you to transfer funds or provide nonpublic personal information, EVEN IF IT APPEARS TO BE FROM Kim Douthit, Realtor or Keller Williams or its affiliates, do not respond to it and immediately contact your real estate agent or title closer. Such requests are likely part of a scheme to defraud you by stealing funds or using your identity to commit a crime.

To notify us of suspected fraud related to your real estate transaction, send an email to [email protected] and [email protected].

8. Your Choices and Contact Information

You may contact us at [email protected] and [email protected] if you: (a) have questions or comments about this Privacy Policy; (b) wish to correct any Personal Information you have provided; (c) want to opt out of future commercial correspondence, including emails, from us, our affiliated companies, or third parties; or (d) wish to withdraw your consent to sharing your Personal Information with others. For texts, reply STOP.

We will respond to your request and, where applicable and appropriate, make the requested change in our active databases as soon as reasonably practicable. Requests may take up to 30 days, and we may not be able to fulfill certain requests while allowing you access to certain benefits and features of our services.

9. California and Other State Privacy Rights

Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship (1) a list of the categories of personal information, such as name, address, email address, and type of services provided, that the business disclosed to third parties (including affiliates that are separate legal entities) during the preceding calendar year for the third parties’ direct marketing purposes, and (2) the names and addresses of all such third parties. Residents of California and certain other states may also have rights to know what personal information we collect, to request correction or deletion, and to opt out of certain sharing. To make a request, contact us as described in Section 8.

10. International Users and European Union Residents

Our website is hosted on servers in the United States. If you are located outside the United States, your personal information may be transferred to, stored, and processed in the United States, and by submitting it you consent to that transfer.

None of our website or services are targeted to, directed to, or intended as solicitations to consumers in the European Union. If the General Data Protection Regulation (“GDPR”) applies to a specific transaction or consumer, that consumer has, under certain circumstances, the right to access, correct, or update Personal Information; to restrict or object to its processing, including for direct marketing and automated decision making; to receive a portable copy; and to request erasure, although some information may be retained in backups or for legal or compliance reasons. To make a request, follow Section 8. We may require identity verification. If a data breach likely to risk your rights and freedoms occurs, we will notify the applicable supervisory authority within 72 hours of becoming aware of it. If you were referred to us by a corporate client or relocation company, we act as a “Data Processor” under that client’s direction as “Data Controller.”
